Humdrum Terms of Service

1. Acceptance of Terms

By accessing or using Humdrum ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of a school, district, or educational institution, you confirm that you have authority to bind that entity to these Terms.

2. Educational Use Only

Humdrum is a writing tool built for 4th–8th graders, used by schools and homeschool families. The Service is designed for educational and creative writing purposes.

Teacher Attestation (Clever Users)

For schools using Clever, the Service operates under the school official exception to COPPA (the Children's Online Privacy Protection Act). By signing in through Clever and creating a classroom, you confirm that:

  • You are authorized by your school or district to use Humdrum with students.
  • Your school acts as the agent for obtaining parental consent under COPPA.
  • You will use the Service only for educational purposes.
  • You will not collect or use student data for any non-educational purpose.

When a school authorizes Humdrum through Clever, that authorization may serve as consent for teachers and students within the approved scope. The specific authorization model depends on how your school or district has configured Clever.

Adult Attestation (Guest Users)

Humdrum also offers guest access for users without Clever. Before creating any guest account or storing any data, a teacher, parent, or guardian must confirm that:

  • They are supervising the student's use of Humdrum.
  • They consent to data collection for educational purposes only.
  • They understand they can request data deletion at any time.

Email-Based Accounts (Multi-Writer)

Parents and guardians can also create an account using their email address. A one-time verification code confirms ownership of the email. For new accounts, consent to educational data collection is required before any student data is stored — if consent is not provided, the account profile is removed. The parent's email address used for verification may be retained in the authentication system for security and abuse-prevention purposes.

3. Account Access and Security

Teachers access Humdrum through Clever single sign-on (SSO) or guest login. Families access Humdrum through email-based accounts or guest login. Guest users must complete adult attestation before their account is created. You are responsible for maintaining the security of your login credentials and for all activity under your account. Please notify us immediately at hello@noticehumdrum.com if you suspect unauthorized access or a security issue.

4. Student Data and Ownership

Student Content Ownership

Students own what they create. Their stories, writing, and creative work belong to them. By using Humdrum, you grant us only the limited rights necessary to operate the Service—such as storing, displaying, and backing up student work.

Data Use

We will never:

  • Sell, rent, or trade student data
  • Use student data for advertising or marketing
  • Share student data with third parties except as needed to run the Service (e.g., secure hosting providers)
  • Use student data to build profiles for non-educational purposes

School, Parent, and Guardian Rights

Schools, parents, and guardians may:

  • Review student data collected through Humdrum
  • Request correction of inaccurate information
  • Request deletion of student data
  • Refuse further collection or use of student information

5. Writing Analysis

Humdrum uses AI-powered writing analysis to detect creative techniques (such as simile, metaphor, and alliteration) in student writing. This analysis powers the educational feedback students see — showing them how their writing skills are growing over time. Student text is processed in real time and discarded immediately by the analysis service. It is not stored, logged, cached, or used for model training. 6. Story Sharing

Children can choose to share their writing with their account owner — a parent or guardian for family accounts, or a teacher for school accounts. Sharing is always initiated by the child. Adults cannot request, pull, or access stories unless the child chooses to share.

When a child shares a story, a snapshot of the content is stored and delivered to the recipient — via email for family accounts, or through an in-app inbox for school accounts. The recipient can send a single reaction back to the child. Shared stories are visible only to the specified recipient and are not published or shared with any third party.

Children may share one story per day. Each story can only be shared once.

7. Acceptable Use

You agree not to:

  • Use Humdrum for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt servers or networks
  • Upload or transmit malware or harmful code
  • Collect personal information from other users
  • Harass, threaten, or abuse others
  • Reverse engineer or decompile the Service
  • Use student data for any commercial or non-educational purpose

8. Clever Integration and Data Sharing

Humdrum integrates with Clever for sign-on and class rostering. We receive the minimum data required to provide the Service: teacher and student names, email addresses (if provided by Clever), and class roster information including section names, grades, subjects, and term dates. All Clever IDs are hashed before storage. Legacy accounts that previously stored unhashed IDs are migrated to hashed values and the raw ID is cleared on the user's next sign-in. Data sharing follows both these Terms and the Clever Universal Data Sharing Agreement.

9. Service Availability and Updates

Humdrum is offered as-is and as-available. We may modify, suspend, or discontinue parts of the Service at any time. If we make significant changes, we'll notify registered users through the Service or by email.

10. Premium Features

Humdrum's core writing experience is free. Some features (such as Side Quests) may require a paid subscription. Pricing, availability, and subscription terms will be communicated before purchase. You can cancel at any time.

11. Intellectual Property

Service Ownership

All Humdrum software, design, text, and graphics (excluding student work) are owned by Big & Important, LLC and protected by intellectual property laws.

Student Work

Students retain full ownership of their writing and creative work. We claim no rights over their content beyond what's needed to operate the Service.

12. Termination

We may suspend or end access for any user that:

  • Violates these Terms
  • Misuses the Service or interferes with others
  • Fails to comply with applicable laws

Users may end use at any time by contacting hello@noticehumdrum.com. When accounts are closed, we delete student data in line with our Privacy Policy and applicable data retention rules.

13. Disclaimers and Limitation of Liability

Disclaimer

Humdrum is provided "as is" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will always be uninterrupted or error-free—but we'll do our best to keep it running smoothly.

Limitation of Liability

To the fullest extent allowed by law, Big & Important, LLC is not liable for indirect, incidental, or consequential damages, including loss of data, profits, or goodwill, arising from:

  • Use or inability to use the Service
  • Unauthorized access or security breaches
  • Service interruptions or data loss
  • Bugs, malware, or other harmful code
  • Errors or omissions in any content

14. Indemnification

You agree to hold harmless Big & Important, LLC, its employees, and agents from any claims or damages arising from your use of the Service or violation of these Terms.

15. Data Security

We use reasonable technical, administrative, and physical safeguards to protect student data. No online system is perfectly secure, but we take security seriously and continually work to improve it.

16. Compliance with Laws

You agree to comply with all applicable federal, state, and local laws, including COPPA, FERPA, and any state student data privacy acts. If you're outside the U.S., you acknowledge that data will be processed in the United States.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington. If any dispute arises, both parties agree to try to resolve it in good faith. If court action is necessary, it will take place in Washington State.

18. Changes to These Terms

We may update these Terms as Humdrum grows. If we make material changes, we'll notify you by email or within the Service before they take effect. Continuing to use Humdrum after an update means you accept the revised Terms.

19. Severability

If any part of these Terms is found invalid or unenforceable, the rest will still apply.

20. Entire Agreement

These Terms, together with our Privacy Policy, form the entire agreement between you and Big & Important, LLC about your use of Humdrum.
